California Candidate Privacy Addendum

This California Candidate Privacy Addendum (“Addendum”) supplements SharkNinja’s Candidate Privacy Notice and applies only to individuals who reside in the State of California. It is intended to comply with the California Consumer Privacy Act of 2018 (“CCPA”) as amended by the California Privacy Rights Act of 2020 (“CPRA”).

If there is a conflict between this Addendum and the Candidate Privacy Notice, this Addendum will govern for California residents.

Categories of Personal Information Collected

In the past 12 months, SharkNinja has collected the following categories of Personal Information about candidates:

  • Identifiers: Name, contact details, address, government ID, and online identifiers.
  • Professional or employment information: Work history, education, qualifications, achievements, and test results.
  • Characteristics of protected classifications: Gender, race/ethnicity, veteran status, and disability status, if voluntarily disclosed or required by law.
  • Internet or electronic network activity information: Interactions with our recruiting platforms.
  • Audio, electronic, visual, or similar information: Audio and video recordings of interview sessions captured through AI-assisted interview recording tools, together with AI-generated transcripts and interview notes derived from the recording content.
  • Inferences drawn from Personal Information: AI-generated fraud signals and match reasoning derived from application data, and AI-generated categorical ranking outputs derived from CV content, work history, qualifications, and skills.
  • Sensitive Personal Information: Diversity and inclusion data and criminal history used for background checks, where permitted by law.
Sources of Personal Information

We collect Personal Information directly from you, from professional recruiting firms, prior employers, references, publicly available sources (e.g., LinkedIn), and SharkNinja employees involved in recruitment.

Business or Commercial Purposes for Collection and Use

We use Personal Information for:

  • Recruiting, evaluating, and hiring candidates, including through AI-assisted interview recording, note generation, and application ranking tools that support human decision-making by the recruitment team.
  • Compliance with legal obligations.
  • Maintaining diversity, equity, and inclusion programs.
  • Creating a talent pool for future opportunities.
  • Security and fraud prevention, including AI-assisted fraud signal detection applied at the application stage to protect the integrity of the recruitment process.
  • Profiling to assess candidate suitability for a role by automated means, including evaluation of professional background, experience, and application content. No hiring decision is made solely on the basis of an AI-generated output.
Disclosure of Personal Information

SharkNinja does not sell or share candidate Personal Information for cross-context behavioral advertising.

We may disclose Personal Information to service providers and contractors (e.g., recruiting firms, background check providers, and IT providers) for legitimate business purposes.

Your Rights Under CCPA/CPRA

As a California resident, you may have the right to:

  • Know: Request information about the categories and specific pieces of Personal Information we collect, use, and disclose.
  • Delete: Request deletion of your Personal Information, subject to legal exceptions.
  • Correct: Request correction of inaccurate Personal Information.
  • Limit Use of Sensitive Personal Information: Request that we limit our use of Sensitive Personal Information to what is necessary for recruitment and compliance.
  • Opt-Out of Sale/Sharing: SharkNinja does not sell or share candidate Personal Information.
  • Non-Discrimination: You will not be discriminated against for exercising your rights.

Artificial Intelligence in Recruitment

SharkNinja uses AI-powered tools within its applicant tracking system to support three specific activities: interview recording and note generation; fraud signal detection at the application stage; and application ranking. Details of each activity are set out in the main Candidate Privacy Notice.

All three AI tools support human decision-making. No decision about your application is made solely on the basis of an AI output. A member of the SharkNinja recruitment team reviews AI-generated outputs before any decision is made.

Real Talent and Talent Matching involve profiling; we use automated processing to evaluate aspects of your professional background and application data to assess your suitability for a role. Under CCPA/CPRA, you have the right to opt out of profiling that produces legal or similarly significant effects. To exercise this right or to request that your application is reviewed without reliance on AI-generated outputs, please contact [email protected].

In accordance with applicable AI regulation, SharkNinja confirms that the AI tools used in recruitment are classified as high-risk AI systems under the EU AI Act. SharkNinja operates as a deployer of these systems and maintains human oversight throughout the recruitment process.

We may update this Addendum from time to time. Changes will be effective as of the “last updated” date.
